poker and potFrom what I understand, online poker is operating under a grey area. UIGEA has been interpreted in different ways, and some actually support the legality of online poker. However the US government used it to seize what assets they could of the 3 largest sites. However, it appears that while there are a few individuals being charged, the poker sites themselves don't necessarily have enough evidence against them to be charged with illegal activity. Instead of taking the whole thing to trial the us government agreed to not hold the sites accountable for any illegal activity and the poker sites agreed to stay out of the US market until online poker was definitively legal. Most other sites decided it wasn't worth the financial risk to stay in the US market in the unstable environment, but a few have stayed open and are taking the risk of future action from the US government.
